Cops still waiting for a medical report; earlier grappled with jurisdiction wrangles

Mukesh Kumar Garain's injuries will be healed with time but the mental trauma he underwent on Monday evening will haunt him for years.

Garain, an alleged victim of road rage, is still awaiting the police to register his FIR even as 24 hours have passed. The police said that they were waiting for a medical report to register the complaint, as it is not possible for them to proceed without a medico-legal report.

A local Munirka shopkeeper beat Garain, administrative head with an NGO, after the former's car missed Garain's vehicle by a few inches near Qutub Institutional area in south Delhi. Garain had alleged that Kishanjiu00a0- the shopkeeper - called up some locals who also beat him and his colleague Varun.

Garain's lawyer Abhishek Sharma, who practices in the Supreme Court, thrashed Delhi police for their negligent attitude. "As per the law police should not wait to determine the exact sections under which the FIR can be registered. As soon as an offence is committed the police should nab the culprits," he told MiD DAY.

Over the status of medical report he added, "a medical report can alter the nature of case and the application can be modified according to it but for that police first need to catch the culprit."

"For almost two hours the cops could not determine the police station under which the areas falls. While Hauz Khas police claimed that the area comes under Vasant Kunj there was no trace of the latter," said Garain.u00a0

"Till last minute cops said that they cannot register an FIR in absence of a supporting medical report. It's ridiculous," said Sharma.u00a0

Delhi police recorded Garain's statement post midnight on Tuesday.
